Company Penalized for Discriminatory Job Ad Targeting White Candidates Only
Arthur Grand Technologies, an IT services firm based in Virginia, has been fined and reached settlements with the U.S. Department of Justice (DOJ) and Department of Labor for posting a discriminatory job advertisement in March 2023. The ad sought “only US Born Citizens [white]” for a business analyst position in Dallas, Texas, and specifically instructed not to share this requirement with candidates. The DOJ’s investigation revealed that the ad, posted by a recruiter from Arthur Grand’s subsidiary in India, discriminated based on citizenship and national origin.
As a result of the settlements, Arthur Grand must pay a civil penalty, revise its employment policies, and train its staff on the Immigration and Nationality Act’s requirements. Additionally, they will compensate individuals who filed complaints with the Office of Federal Contract Compliance Programs (OFCCP) and provide specific workplace training for all employees involved in recruitment. The company also violated Executive Order 11246, which prohibits employment discrimination by federal contractors.
Officials condemned the discriminatory practices, emphasizing the continued fight against such violations. The DOJ and Labor Department highlighted their commitment to holding federal contractors accountable for discriminatory practices.
