New Law Clarifies Health Protections for Pregnant Workers, Leaves Allowance Criteria Intact

Finland Updates Pregnancy Worker Protections for 2024; Special Allowance Criteria Unchanged

Finland has introduced a new decree, set to take effect in April 2024, aimed at enhancing health and safety protections for pregnant workers, those who have recently given birth, or are breastfeeding. This move is designed to bring Finnish regulations in line with the EU Directive concerning the protection of pregnant workers. Despite these updates, the criteria for receiving special pregnancy allowance from Kela, the Finnish social security institution, will remain unchanged. This allowance is crucial for pregnant workers who need to avoid certain workplace hazards, as outlined under the Health Insurance Act, before they are eligible for the regular pregnancy allowance.

The decree mandates employers to safeguard pregnant workers from an expanded list of recognized workplace hazards, including exposure to harmful noise levels, physically demanding tasks, and potential violence, reflecting a broader understanding of modern workplace risks. Employers and occupational healthcare providers are advised to familiarize themselves with these changes to ensure the continued protection of pregnant workers.

It’s important for pregnant workers and healthcare providers to note that the eligibility criteria for Kela’s special pregnancy allowance remain unaffected by this decree. The allowance is specifically designed for those unable to work due to risks such as chemical substances, radiation, and infectious diseases. Pregnant workers are encouraged to consult with Kela and their occupational healthcare providers to assess their eligibility for this benefit under the existing regulations.

This legislative update underscores the Finnish Government’s commitment to the well-being of pregnant workers by reinforcing safety standards without altering the benefits system.
