Private Citizens File Amicus Brief Supporting Trump’s Motion to Dismiss Indictment in Classified Documents Case

Two private individuals, Jessica Nan Berk and Hilda Tobias Kennedy, have filed a motion in support of former President Donald Trump’s bid to dismiss the indictment against him in the Florida classified documents case. They argue that the prosecution is a “misuse of government funds” that does not align with the “people’s interest of justice.” Identifying as “disabled, pro se, indigent, private citizens, elderly,” Berk and Kennedy believe their experience and knowledge could be beneficial to the case. Their motion criticizes the allocation of public funds towards this litigation, suggesting that these resources should instead be directed towards crimes against more vulnerable populations. Special Counsel Jack Smith, who leads the prosecution, charged Trump with 40 federal counts related to the illegal retention of classified documents and obstruction efforts. The case has sparked controversy, with Judge Aileen Cannon, a Trump appointee, facing criticism for delaying the trial without setting a start date. Additionally, the involvement of non-party actors like Berk and Kennedy, who seek to present an amicus brief and participate in oral arguments, has been described as “unusual” by Dave Aronberg, state attorney for Palm Beach County, raising concerns about the potential for the hearing to become a “circus.” The Southern District of Florida office has refrained from commenting on the pending case.
