Appeals Court Reverses Decision Denying Texas Firm’s Litigation Proceeds
The US Circuit Court of Appeals for the Fifth Circuit ruled that lawyers from a Texas law firm, previously known as McClenny Moseley & Associates PLLC (MMA), should not have been denied their litigation proceeds by a federal trial court judge. This decision came after the judge found that the firm had improperly solicited claims following hurricanes in Louisiana. While the attorneys were allowed to challenge their suspensions, they were not given the opportunity to argue against the forfeiture of their fees, a situation the appeals court found to be procedurally unfair.
